Payify, Inc. ("Payify", "we", "us", or "our") respects your privacy. Payify obtains Personal Data about you to provide our Services and to manage our Sites. "You" may be a visitor to one of our websites, a user of one or more of our Services ("Merchant"), or a customer of a Merchant ("Customer"). whether you are a Merchant who uses Payify's products, applications, or services (together, the "Services"), a Customer that shops at a store using our technology, or whether you're simply visiting this website.

This Privacy Policy describes the types of Personal Data we collect through our products, applications, and services ("Services") and via our online presence, which include our main website at payify.com, as well as services and websites that we enable Internet users to access (collectively, our "Sites"). This Privacy Policy also describes how we collect and store your personal information, how we use it, with whom we share it, and your rights and choices. This policy does not apply to third-party websites, products, or services, even if they link to our Services or Sites, and you should consider the privacy practices of those third-parties carefully.

By using any of Payify's Services, or by dealing with a Merchant using Payify's Services, you are agreeing to the terms of this Privacy Policy and, as applicable, the Payify Terms of Service.

1. Personal Information We Collect

We collect various personal information which includes the following:

a. Information we collect if you are a Merchant

  • When you sign up for our Services we will collect your full name, company name, address, phone number, email address, and a portion of your payment information (such as the last four digits of your credit or debit card number and expiration date). We do not collect, store, or transmit your sensitive payment information. Complete payment information is handled and processes by your payment service provider. Stripe uses and processes your complete payment information in accordance with Stripe's privacy policy.
  • Your email address, name and any other information you choose to include in the body of your email or responses or when you respond to Payify emails.
  • Your full name, email address, country, and anything else you tell us about your business when you fill in our online form to contact our sales team.

b. Information we collect if you are a Customer

  • If you are a Customer, when you make payments or conduct transactions with a Merchant, we will receive your transaction information. Depending on how the Merchant implements our Services some or all of the following information may be collected: Your name, company name, billing address, shipping address, phone number, email address, and a portion of your payment information (such as the last four digits of your credit or debit card number and expiration date). We do not collect, store, or transmit your sensitive payment information. Complete payment information is handled and processed by the payment service provider of your selected payment method.
  • Information from your use of the Services or Merchants' sites. This includes: IP addresses, preferences, web pages you visited prior to coming to our or our Merchants' sites, information about your browser, network or device (such as browser type and version, operating system, internet service provider, and preference settings).

c. Information that we collect automatically.

  • Browser and device data, such as IP address, device type, operating system and Internet browser type, screen resolution, operating system name and version, device manufacturer and model, language, plug-ins, add-ons and the language version of the Sites you are visiting;
  • Usage data, such as time spent on the Sites, pages visited, links clicked, and the pages that led or referred you to our Sites.
  • We also may collect information about your online activities on websites and connected devices over time and across third-party websites, devices, apps and other online features and services. We use Google Analytics on our Sites to help us analyze Your use of our Sites and diagnose technical issues.

2. How we collect personal information

We obtain personal information from various sources. We do this in three main ways:

  • You provide some of it directly (such as by registering for an Account).
  • We record some of it automatically when you use our Services or Merchants' sites (including with technologies like cookies).
  • We receive some of it from third parties (like when you register for an account using a Third Party Service or when you make payments to us using our payment processor).

3. How We Use Personal Information

a. If you are a Merchant

We use the personal information we obtain about you in the following ways:

  • Create a Payify account for you and to give you access to and improve our Services.
  • Provide you with our Services and so that you can process orders and better serve your customers.
  • Contact you, provide you with advertising and marketing, and invoice you.
  • Communicate with you, including by sending you emails about your transactions and Service-related announcements.
  • Analyze and improve the safety and security of our Services - we do this as it is necessary to pursue our legitimate interests in ensuring Payify is secure, such as by implementing and enhancing security measures and protections and protecting against fraud, spam, and abuse.
  • To prevent, investigate, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our Terms of Service or any other agreement related to the Services, or as otherwise required by law.
  • To conform to legal requirements, or to respond to lawful court orders, subpoenas, warrants, or other requests by public authorities (including to meet national security or law enforcement requirements).

b. If you are a Customer

Our Merchants who use our Services are responsible for what they do with the personal information they collect, directly or through Payify, about their Customers. Your agreement with the relevant Merchant should explain how the Merchant shares your Personal Data with Payify, and if you have questions about this sharing, then you should direct those questions to the Merchant.

We use the personal information we obtain about you in the following ways:

  • Create and give access to an account for you on behalf of our Merchants.
  • Provide to our Merchants so that they can process orders and better serve you.
  • Analyze and improve the safety and security of our Services - we do this as it is necessary to pursue our legitimate interests in ensuring Payify is secure, such as by implementing and enhancing security measures and protections and protecting against fraud, spam, and abuse.

4. How We Share Personal Information

Payify may share your Personal Information with:

a. Service providers Service providers that perform services on our behalf. For example, may use third parties to help us provide payment processing services.

b. Merchants We share Personal Data with Merchants as necessary to maintain a Merchant account and provide the Services. The use of Personal Data by the Merchant is subject to the Merchant's privacy policy.

c. Business transfers If we're involved in a reorganization, merger, acquisition or sale of some or all of our assets, your personal information may be transferred as part of that deal.

d. Legal requirements or compliance Following the law or protecting rights and interests. We disclose your personal information if we determine that such disclosure is reasonably necessary to comply with the law, protect our or others' rights, property or interests (such as enforcing our Terms of Service) or prevent fraud or abuse of Payify or our Merchants. In particular, we may disclose your personal information in response to lawful requests by public authorities, such as to meet national security or law enforcement requirements.

e. Advertising We share personal information with third parties so they and we can provide you with tailored advertising and measure and monitor its effectiveness. For example, we may share your pseudonymized email address with a third party social media platform on which we advertise to avoid serving Payify ads to people who already use Payify.

5. Your Rights and Choices

Payify understands that you have rights over your personal information, and takes reasonable steps to allow you to access, correct, amend, delete, port, or limit the use of your personal information. Your choices regarding our use and disclosure of your Personal Data include:

a. Opting out of receiving electronic communications from us. If you no longer want to receive marketing-related emails from us, you may opt-out via the unsubscribe link included in such emails. We will try to comply with your request(s) as soon as reasonably practicable. Please note that if you opt-out of receiving marketing-related emails from us, we may still send you important administrative messages that are required to provide you with our Services.

b. How you can see or change your account Personal Data. If You would like to review, correct, or update Personal Data that You have previously disclosed to us, You may do so by signing in to your Payify account or by contacting us.

c. Your data protection rights. Depending on your location and subject to applicable law, you may have the following rights with regard to the Personal Data we control about you:

  • The right to request confirmation of whether Payify processes Personal Data relating to you, and if so, to request a copy of that Personal Data;
  • The right to request that Payify rectifies or updates your Personal Data that is inaccurate, incomplete or outdated;
  • The right to request that Payify erase your Personal Data in certain circumstances provided by law;
  • The right to request that Payify restrict the use of your Personal Data in certain circumstances, such as while Payify considers another request that you have submitted (including a request that Payify make an update to your Personal Data); and
  • The right to request that we export to another company, where technically feasible, your Personal Data that we hold in order to provide Services to you.

Where the processing of your Personal Data is based on your previously given consent, you have the right to withdraw your consent at any time. You may also have the right to object to the processing of your Personal Data on grounds relating to your particular situation.

d. Process for exercising data protection rights. In order to exercise your data protection rights, you may contact Payify as described in the Contact Us section below. We take each request seriously. We will comply with your request to the extent required by applicable law. We will not be able to respond to a request if we no longer hold your Personal Data. If you feel that you have not received a satisfactory response from us, you may consult with the data protection authority in your country.

For your protection, we may need to verify your identity before responding to your request, such as verifying that the email address from which you send the request matches your email address that we have on file. If we no longer need to process Personal Data about you in order to provide our Services or our Sites, we will not maintain, acquire or process additional information in order to identify you for the purpose of responding to your request.

If you are a merchant, you can update many types of personal information, such as payment or contact information, directly within your account settings. If you are unable to change your personal information within your account settings, or if you are concerned about data collected as you visit Payify's websites or use our support services, please contact us to make the required changes. It's important to remember that if you delete or limit the use of your personal information, the Services may not function properly.

If you are a Customer of a Merchant and wish to exercise these rights, please contact the merchants you interacted with directly. For example, if you are making, or have made, a purchase from a Merchant's storefront, and you have a request that is related to the information that you provided as part of the purchase transaction, then you should address your request directly to the merchant. It's important to remember that if you delete or limit the use of your personal information, the Services may not function properly.

6. Security and Retention

We make reasonable efforts to ensure a level of security appropriate to the risk associated with the processing of Personal Data. We maintain administrative, technical and physical measures that are intended to appropriately protect against accidental or unlawful destruction, accidental loss, unauthorized alteration, unauthorized disclosure or access, misuse and any other unlawful form of processing of, the personal information in our possession. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of your account has been compromised), please contact us immediately.

If you are a Merchant, we retain your Personal Data as long as we are providing the Services to you. We retain Personal Data after we cease providing Services to you, even if you close your Payify account, to the extent necessary to comply with our legal and regulatory obligations, and for the purpose of fraud monitoring, detection and prevention. We also retain Personal Data to comply with our tax, accounting, and financial reporting obligations, where we are required to retain the data by our contractual commitments to our financial partners, and where data retention is mandated by the payment methods that we support. Where we retain data, we do so in accordance with any limitation periods and records retention obligations that are imposed by applicable law. Once you terminate your relationship with us, we generally will continue to store archived copies of your personal information for legitimate business purposes and to comply with the law, except when we receive a valid erasure request, or, if you are a merchant, you terminate your account and your personal information is purged pursuant to our standard purge process.

For our Merchants' customers, we process and retain your information solely as a data processor on behalf of our Merchants, and it is up to the Merchant to determine how long they will store your information in our systems.

7. Information from cookies

A cookie is a small amount of data sent from a website you visit to your browser which then stores that data on your device. Cookies make your browsing experience better by allowing the website to remember your actions and preferences. This means you don’t have to re-enter this information each time you return to the site or browse from one page to another. Typical uses of cookies are to include a unique identifier to keep you signed in to a website, temporarily store the items in your cart, or hold your preferences for how you use a website or how it is displayed. 8. Updates To this Privacy Policy and Notifications

We may update this Privacy Policy from time to time in order to reflect changes to our privacy practices or for other operational, legal, or regulatory reasons. If we make material changes to this Privacy Policy, we will give you notice of such changes by posting the revised policy on this Website, and where appropriate, by other means. By continuing to use this Website or the Support Service after these changes are posted, you agree to the revised policy.

The Services may provide the ability to connect to other websites. These websites may operate independently from us and may have their own privacy notices or policies, which we strongly suggest you review. If any linked website is not owned or controlled by us, we are not responsible for its content, any use of the website or the privacy practices of the operator of the website.
